Seen the office report dated 28.3.2018, notices were issued on the writ and stay application through R.P.A.D. but neither A.D. nor undelivered envelop has been received back.
In view of the provision contained under Chapter VIII Rule 12, Explanation (II) of the High Court Rules, service of notices are deemed to be sufficient upon opposite party no. 4/1.
Civil Misc. Substitution Application No. 219102 of 2014.
Seen the office report dated 28.3.2018, notice was issued to the opposite party no. 4/1 through R.P.A.D. but neither A.D. nor undelivered envelop has been received back.
Thus, in view of the provisions under Chapter VIII, Rule 12, Explanation (II) of the High Court Rules, notice is deemed to be sufficient.
Sri Ashutosh Kumar Misra, Advocate has put in appearance on behalf of legal heirs of respondent no. 4/1 and he has no objection in case the substitution application is allowed.
The substitution application has been filed for substitution of the legal heirs of opposite party no. 4 Hiraman, who has been detailed in paragraph 2 of the affidavit.
In view of the above, the substitution application is allowed.
Office is directed to carry out necessary incorporation in the array of the parties.
List this petition for final hearing on 23.4.2018.
