Heard learned Counsel for the petitioner and learned Standing Counsel.
Petitioner is alleging negligence on part of respondent no.5, Dr Swarnlata Singh, who is proprietor of Ashwani Memorial Hospital, District Varanasi. The petitioner has also prayed that suitable action be taken against her and she be punished and at the same time, the registration of the hosptial be cancelled.
For the reliefs as claimed above, the remedy of the petitioner is elsewhere, may be before the Consumer Disputes Redressal Commission and for cancellation of the registration before the registering authority under the Clinical Establishments (Registration and Regulation) Act, 2010.
The writ petition for the purpose is not maintainable and is, accordingly, dismissed.
