Heard learned counsel for the petitioners, Shri Rajesh Srivastava, learned Standing Counsel for the State respondent.
Petitioners are before this Court with the request to quash the impugned orders dated 17.01.2018 passed by Additional District Magistrate (Finance & Revenue) Deoria under Section 33/39 L.R. Act 1901.
At the very outset, the learned Standing Counsel raised a preliminary objection that against the order impugned dated 17.01.2018 passed in the aforesaid case, the petitioners have got alternative remedy to file revision and as such, request has been made that once the petitioners have got efficacious alternative remedy of filing revision, in such a situation there is no reason or occasion to entertain the writ petition.
Confronted with this situation, learned counsel for the petitioners submits that leave may be accorded to the petitioners for preferring revision before the Authority concerned In the aforesaid facts and circumstances, on consent, the writ petition is disposed of with the direction that in case the petitioners file revision within three weeks from today before the Competent Court, this Court hopes and trust that the Revisional Authority would proceed to conclude the said revision expeditiously, without granting any unnecessary adjournment to either of the parties except upon payment of cost, but certainly after providing opportunity of hearing to all the stake holders in the matter.
