The contention of learned counsel for the petitioner is that the Revision being Revision No.C-20170500923 (Hari Nath Tiwari Vs. Yogendra Nath & Ors.) pending in the Court of Commissioner, Gorakhpur Division, Gorakhpur is not being decided.
Learned Standing Counsel in opposition submitted that since with regard to the very same land a writ petition is pending before this Court, no order can be passed.
Be that as it may, the Revisional Court may, after looking into every aspect of the matter and after hearing the respondent, decide the Revision No.C-20170500923 (Hari Nath Tiwari Vs. Yogendra Nath & Ors.) within a period of three months from the date of presentation of a certified copy of this order, if there is no other legal impediment. If he is of the view that the case cannot be proceeded with, he shall, accordingly, pass orders.
The writ petition is, accordingly, disposed of.
