High Court Of Judicature at Allahabad|19 December, 2019

JUDGMENT / ORDER

Court No. - 58
Case :- WRIT - A No. - 20698 of 2019 Petitioner :- Hari Nandan Sharma Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Ashwaini Mishra,Vishnu Dutt Tiwari Counsel for Respondent :- C.S.C.
Hon'ble Dr. Yogendra Kumar Srivastava,J.
Heard Sri Ashwani Kumar Mishra, learned counsel for the petitioner and Sri Mata Prasad, learned Standing Counsel appearing for the State respondents.
The present petition seeks to challenge the order dated 29.11.2019 whereby the petitioner has been transferred from Gautam Budh Nagar to C.B.C.I.D. U.P. Lucknow.
The order of transfer records that the same has been passed on the basis of an administrative report and after due approval from the Police Establishment Board and as such there does not appear to be any illegality in the order.
Moreover, transfer being an exigency of service and the petitioner holding a transferable post, no interference in the aforesaid order is called for.
Counsel for the petitioner has fairly submitted that the petitioner would join his place of posting. He further makes a prayer that the petitioner may be permitted to make a representation before the authority concerned raising his grievances.
Needless to say that in case the petitioner joins his place of posting and submits a representation with regard to his grievances, the same would be considered appropriately by the authority concerned.
With the aforesaid observations, the writ petition stands disposed of.
Order Date :- 19.12.2019 Pratima (Dr.Y.K.Srivastava,J.)
