The present application under Section 482 Cr.P.C. has been filed by the applicant with the prayer to quash the impugned order dated 27.11.2018 passed in criminal revision no.569 of 2018 (Udai Bhan Singh Vs. State of U.P. and others) pending in the Court of Sessions Judge, Agra. Further prayer has been made to stay the impugned order passed in the matter and to direct the court concerned to decide the aforesaid revision within a stipulated period.
Heard learned counsel for the applicant and the learned AGA appearing for the State.
A criminal revision is pending before the revisional court against the summoning order dated 15.10.2018. Revisional court while admitting the revision stayed the effect and operation of the summoning order vide order dated 17.9.2018. If the order passed by the revisional court is taken into consideration along with the prayer made in this application, applicant has an opportunity to raise this plea before the revisional court. No occasion arises to interfere in the order passed by the revisional court staying the effect and operation of the summoning order.
Application, having no force, is accordingly dismissed.
