Vakalatnama filed by Sri Avinash Chandra Srivastava, learned counsel on behalf of respondent no.1 is taken on record.
Heard Sri P.K. Upadhyay, learned counsel for the petitioner, Sri Avinash Chandra Srivastava, learned counsel appearing for the respondent no.1 and Sri Santosh Kumar Mishra, learned counsel appearing for the respondent nos. 2 and 3.
By means of present petition, petitioner has prayed for following reliefs:
(i) Issue a writ, order or direction in the nature of mandamus directing the appellate authority i.e. Respondent no.2 to decide the appeals dated 06.02.2015, 26.02.2016, 15.03.2016, 15.03.2016, 19.03.2016, 15.06.2016, 14.07.2017, 14.07.2017, 21.08.2017, 31.08.2017, 01.12.2017 and 13.12.2017 respectively pending before respondent no.2 against the penalty orders dated 26.11.2014, 07.01.2016, 18.01.2016, 02.01.2016, 15.02.2016, 22.05.2017, 22.05.2017, 14.07.2017, 12.07.2017, 14.07.2017, 11.10.2017 and 11.12.2017 passed by respondent no.3 within a stipulated period fixed by this Hon'ble Court in accordance with law.
(ii) Issue any other writ, order or direction as this Hon'ble Court may deem fit and proper in circumstance of the case.
(iii) To award cost of the petition to the petitioner.
It appears from the record that the petitioner was posted as AG- II in the office of Food Corporation of India, FSD, Varanasi. It is further stated that departmental enquiry was initiated against him. After submission of reply, orders have been passed against him.
Aggrieved with those orders, the petitioner had preferred departmental appeals on 21.04.2014, 02.12.2014, 02.12.2014, 12.05.2015, 11.07.2017, 09.08.2017, 09.08.2017, 27.09.2017 and 04.12.2017 respectively before the respondent no.2.
The only grievance of the petitioner is that their aforesaid appeals filed before the respondents are pending and the same has not been decided so far.
Learned counsel for the respondents fairly states that in case the appeals are still pending and has not been disposed of, the same shall be considered and decided expeditiously.
In view of the above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the respondent no. 2 to consider and decide petitioner aforesaid appeals by a speaking order within a period of eight weeks from the date of production of a certified copy of this order before him.
