Heard learned counsel for the applicant, learned AGA for the State and perused the record of this application.
This application under Section 482 Cr.P.C. has been filed to quash the non- bailable warrant dated 28.3.2019 issued by Additional Chief Judicial Magistrate- 4, Meerut in Complaint Case No.6990 of 2017, under Section 138 Negotiable Instrument Act, Police Station Partapur, District Meerut.
The present application has been filed against quashing of the order dated 28.3.2019 whereby non- bailable warrant has been issued in the instant complaint case. The prayer has been made for staying the operation as the applicant himself is ready to participate in the proceeding of the case provided some reasonable opportunity is given and the applicant shall remain present and will cooperate in the proceeding.
Also heard the learned AGA.
If any application is so moved with written undertaking that the applicant will participate in the proceeding, then he will be allowed to participate in the proceedings and accordingly court below shall proceed further in accordance with law.
Accordingly, this application is disposed off.
