The sole prayer made in the instant petition is for issuing direction to the trial court to decide Misc. Case No.8 of 2017 under Order 9 Rule 9 CPC within a specified time frame.
The case has been registered on the basis of application filed by the plaintiff-respondent. A perusal of order sheet of Misc. Case No.8 of 2017 reveals that on 22.11.2018, the court allowed substitution application for bringing on record the heirs of the deceased plaintiff. The proceedings are still pending.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of with direction to the trial court to decide the application under Order 9 Rule 9 CPC registered as Misc. Case No.8 of 2017 by fixing short dates and without granting unnecessary adjournments to the parties.
