In view of the order proposed to be passed, notices need not issue to the private-respondents.
The petitioner is before this Court for a direction to the Civil Judge (Senior Division), Kanpur to decide application of Defendent No.1/petitioner dated 18.02.2020 filed in Suit No. 110 of 2020 (Manoj Kumar vs. Harish Arora and others) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Senior Division), Kanpur to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
