By means of this writ petition, petitioner has challenged the judgement and decree passed by the first appellate Court in a suit for partition under Section 176 of the U.P.Zamindari Abolition and Land Reforms Act.
Against this order, the petitioner has a statutory alternative remedy of a second appeal before the Board of Revenue has provided under Section 331(4) of the U.P. Zamindari Abolition and Land Reforms Act, which has not been availed.
The writ petition is dismissed on the ground of availability of a statutory alternative remedy.
