Heard Sri Arvind Kumar Srivastava, learned counsel for the petitioner, Sri N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the notice dated 06.04.2018 under section 160 Cr.P.C in case crime no.898 of 2017 under added sections 467, 468, 471, IPC, police station Baghpat, District Baghpat.
Learned counsel for the petitioner submits that initially the FIR was lodged under section 420, 409 IPC which was challenged by the petitioner by means of Crl. Misc. Writ Petition No.23979 of 2017 in which this Court has granted relief to the petitioner vide order dated 7.11.2017 (copy of the order is on record at page 21) and during the course of investigation some other offences under sections 467, 468, 471 have been added.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioner shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
