High Court Of Judicature at Allahabad|18 January, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners and learned Additional Government Advocate.
The petitioners by means of this writ petition under Article 226 of Constitution, have challenged FIR relating to Case Crime No.260 of 2007 under Section 198-A of the U.P. Zamindari Abolition & Land Reforms Act of Police Station Gudamba District Lucknow.
We have gone through the contents of the FIR. In our opinion, since the allegations made in the FIR disclose commission of cognizable offence as such the same cannot be quashed.
However, considering the overall aspect of the matter, we direct that the petitioners shall not be arrested in the above mentioned Case Crime Number till submission of police report under Section 169/173 Cr.P.C., as the case may be. Investigation shall go on and the petitioners shall cooperate with the same.
Subject to the above observations/directions, the petition is finally disposed of.
