Learned counsel for the applicant submits that in compliance of order dated 23.2.2007, a medical board was constituted to ascertain the age of the victim, which opined that the victim was major, aged about 19 years. Letter of Chief Judicial Magistrate, Azamgarh, to this effect is on record.
Learned counsel further submits since applicant no. 1 and the victim have solemnized marriage and living altogether, therefore, the present application has become infructuos and he has no objection if same is disposed of as infructuous.
In view of above, the present application is disposed of having become infructuous.
Interim order, granted earlier, stands discharged.
