Heard Sri Balendra Kumar Singh, learned counsel for the applicant and learned A.G.A. for the State.
This is an application under Section 482 Cr.P.C. seeking to direct the learned Additional District and Sessions Judge, Kaushambi to decide Sessions Trial No. 413 of 2017, State VS. Suneel @ Chhakku (arising out of case crime no. 290 of 2016), under Sections 363, 366, 376 I.P.C. and 3/4 of the POCSO Act, Police Station- Mahewaghat, District- Kaushambi.
It is submitted that the applicant is the informant. After committal on 05.09.2017, charges have been framed on 15.11.2017. The case has been set down for trial.
A perusal of the order sheet shows that 29.11.2017, 13.12.2017, 23.12.2017, 08.01.2018, 20.01.2018, 05.02.2018, 20.03.2015, 06.03.2018, 22.03.2018, 05.04.2018 and 18.4.2018 are various dates fixed during the relevant period of time, but the proceedings are eventless. Only dates have been fixed in this matter but no evidence has been recorded and the trial is not progressing. The trial is still very young being one that is of the year, 2017.
Looking to the facts and circumstances of the present case, the trial court is directed to make all endeavour to expedite proceedings and conclude the same without any unnecessary adjournment on any account including motions by parties.
The application is, accordingly, disposed of.
