JUDGMENT / ORDER

Court No. - 33
Case :- MATTERS UNDER ARTICLE 227 No. - 2828 of 2018 Petitioner :- Harish Chandra Respondent :- Civil Judge (Jr. Div) Jaunpur And 4 Others Counsel for Petitioner :- Sanjeev Kumar Khare
Hon'ble Manoj Misra,J.
Heard learned counsel for the petitioner.
The present petition has been filed by defendant of Original Suit No. 504 of 2005 for a direction upon the Civil Judge (Jr. Div.), Jaunpur to decide temporary injunction application 6-C of the plaintiff.
The grievance of the petitioner is that an ex parte interim injunction has been obtained by the plaintiff which is continuing even though an objection has been filed by the defendant.
Without expressing any opinion on the merits of the claim of the petitioner, this Court considers it appropriate to dispose of this petition with a direction upon the court concerned to ensure that after considering the objection of the petitioner a final decision is taken on the said interim injunction application, expeditiously, preferably, within a period of two months from the date of production of certified copy of this order, unless there is any legal impediment in doing so.
With the aforesaid observation/direction, the petition stands disposed of. Order Date :- 25.4.2018 Sunil Kr Tiwari
