Heard learned counsel for the petitioner, learned Standing Counsel and Ms. Shambhavi Tiwari learned counsel holding brief of Sri Rohit Pandey for the respondent University.
The petitioners challenge an order of 02 June 2021 pursuant to which the Director of the University Institute of Health Sciences has provided that all employees working on contractual basis would have to be subjected to a practical test in order to evaluate their suitability for being continued in employment. The petitioners, as the record reflects, had been engaged on contractual terms by the respondents for a period of one year. That engagement has been extended from time to time. It is thus manifest that no lien exists on any post pursuant to which the petitioners may claim permanency of employment in the respondent University. In any case the Court finds no illegality in the decision taken by the respondents since the petitioners cannot possibly assert any right to continue in service irrespective of their suitability being adjudged and evaluated.
The writ petition consequently fails and shall stand dismissed.
