JUDGMENT / ORDER

Court No. - 34
Case :- WRIT - A No. - 35145 of 2003 Petitioner :- Harish Chandra Dubey Respondent :- Addyakashya (Chairman) U.P. Forest Corp. Lucknow And Others Counsel for Petitioner :- Tej Prakash Mishra,B.M. Chaturvedi Counsel for Respondent :- V.K. Singh,S.C.
Hon'ble Sudhir Agarwal,J.
1. Called in revise. None appeared on behalf of petitioner.
2. By means of the present writ petition, petitioner has sought the following reliefs:
"(i) a writ, order or direction in the nature of certiorari quashing the judgment and order dated 21/23.5.2003 passed by the respondent no. 1 (Annexure no. 1 to the writ petition).
(ii) a writ, order or direction in the nature of certiorari quashing the punishments in order dated 19/20.2.2002 passed by the respondent no. 2 (Annexure no. 2 to the writ petition).
(iii) issue a writ, order or direction in the nature of mandamus commanding the respondents to release the salary of the petitioner which are due to him since the dates of his suspension order dated 18.5.2001 till today onwards and in future shall also continue the full salary for full months to the petitioner without any break.
(iv) issue a writ, order or direction in the nature of mandamus directing the respondents to release the salary of the petitioner for the month of April, 2001 and also 12 days salary of the month of May, 2001 as well as the travelling allowances bill since 26.4.2001 till 12.5.2001.
(v) issue a writ, order or direction in the nature of certiorari quashing the charges labelled through the charge sheet against the petitioner on 16.8.2001 which is as Annexure No. 9 to the writ petition and also to quash the charges dated 28.1.2003 of Rs. 4347.50 (Annexure no. 18 to the writ petition).
(vi) issue a writ, order or direction in the nature of mandamus commanding / directing the respondents to give all the benefits of services, which are due to the petitioner from the dates of his suspension order dated 18.5.2001 till today onwards and in future shall continue without any break."
3. However, I have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
6. Sri V.K. Singh, Advocate is present for respondents.
Order Date :- 24.8.2018 AK
