Heard Sri Indrakesh Kumar Sharma, learned counsel for the petitioner and learned Standing Counsel for respondents No.1 and 2. Notice need not be issued to respondents No.3 and 4 at this stage.
This writ petition has been filed with the following prayer:
"issue a writ order or direction in the nature of mandamus directing the Tehsildar, Tehsil Khalilabad, District Sant Kabir Nagar to decide the Case No.T201817650207368 (Hari Bhajan Vs. Ram Milan) Under Section 34/35 of the Uttar Pradesh Revenue Code, 2006, pending before the Tehsildar, Tehsil Khalilabad, District Sant Kabir Nagar, expeditiously within specified period as may be fixed by this Hon'ble Court."
It is contended that mutation proceedings under Section 35 of the U.P. Revenue Code, 2006 is pending since 2018. The sole prayer is for early disposal of the aforesaid proceedings.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no. 2 to conclude the proceedings of aforesaid case, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
