As there is an alternative remedy of filing an appeal against incorrect orders of Tehsildar to the SDM as provided under sub- section 2 of Section 35 of UP Revenue Code, 2006, this writ petition is not maintainable.
In view of above, the writ petition is dismissed as withdrawn with liberty to the petitioner to approach the appellate authority. It is made clear that in case petitioner approaches the appellate authority within 15 days from today, the appellate authority shall deal with the case on its own merits and shall not advert to aspect of limitation.
