This application under Section 482 of the Code of Criminal Procedure has been filed for quashing of the chargesheet dated 13 March 2016 filed in case crime no. 105/2016 under Section 364 I.P.C., P.S. Masoorie, District Ghaziabad and to stay the further proceedings of Sessions Trial No. 186/2017 (Lala and other Vs. State of U.P. and other) pending in the Court of Additional Sessions Judge, Court No. 8, District Ghaziabad.
The contention of the applicants is that they have already been granted bail and are appearing before the court below on the dates fixed. It is their case that they are innocent and one Subodh s/o Ratnu who is involved in case crime no. 432 of 2015 lodged in P.S. Masoorie, District Ghaziabad under Section 379 I.P.C. on 9 June 2015 is the main culprit and the applicants have been falsely implicated in the case due to long standing village rivalry.
Learned A.G.A. states that proceedings are going on before the court below and there is no justification on the part of the applicants at the present stage to seek interference in the proceedings or for quashing of the chargesheet filed in 2016.
We are inclined to agree with the contention of the learned A.G.A. The applicants have not made out any ground for interference by this Court in its exercise of its jurisdiction under Section 482 Cr.P.C.
This Application under Section 482 is, accordingly, dismissed.
