The present anticipatory bail application has been filed by the applicant with a prayer to enlarge him on bail in This anticipatory bail application under Section 438 Cr.P.C. has been moved seeking the bail of applicant-Harendra Singh in the event of his arrest in Case Crime No.202 of 2021, under Section 306 I.P.C., Police Station Nidhauli, District Etah.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material available on record.
Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He has committed no offence. The prosecution story is false and fake. It is further submitted that no offence under Section 306 I.P.C. is made out against the applicant. The applicant is not responsible for committing suicide of Jai Kishan. He further submitted that the investigation of the matter is going on. The applicant is a member of reputed family. In case, the applicant is enlarged on anticipatory bail, he shall not misuse the liberty of bail and would co-operate with the investigation.
Learned AGA vehemently opposed the application and submitted that the applicant directly approached this Court for seeking anticipatory bail. He did not approach the Sessions Judge.
Having regard to the submissions made by learned counsel for the parties, seriousness of allegation levelled against the applicant, I do not see any good ground to release the applicant on anticipatory bail.
Accordingly, the anticipatory bail application is rejected.
