Heard Mr. Dinesh Kumar Singh, learned counsel for the applicants and the learned A.G.A. for the State.
At the very outset learned counsel for the applicants submits that the interest of justice shall be served in case a direction issued to the court below to consider the bail application of the applicants expeditiously.
Having heard learned counsel for the applicant and upon perusal of the material on record, it is hereby directed that in case the applicants appear before the court below on or before 27th August, 2018, then the court below shall proceed to consider the bail application of the applicants expeditiously in the light of the judgement of this court in the case of Brahm Singh and Ors. Vs. State of U.P. and Others, reported in 2016 (7) ADJ 151.
As an interim measure, it is further directed that till 27th August, 2018, no coercive action shall be taken against the applicants.
However, in case of default, interim protection granted to the applicants as well as the direction issued to the court below to consider the bail application of the applicants expeditiously both shall stand revoked automatically and the court below shall thereafter proceed against the applicants in accordance with law.
With the aforesaid observations/directions, the present application stands finally disposed of.
