1. Heard learned Advocates Mrs. Pahwa and Mr. Shah appearing on behalf of the respective parties.
2. The learned Counsel for the petitioner submits that the petitioner issued the statutory Notice u/s. 434 of the Act on 8.9.2011 upon the respondent demanding an amount of Rs.64,52,950/-. The said Notice has been duly received by the respondent. However, no reply was given by the respondent.
3. The Court issued Notice on the petition, which is duly served upon the respondents. However, no reply to the petition is filed opposing the present petition. The learned Counsel for the respondent is also unable to dispute the contents of the petition.
4. Considering the facts and circumstances of the case, it appears to the Court that the petition is required to be admitted and consequential directions are also required to be issued. Hence Admit.
5. The petitioner is directed to publish the Notice of petition in 'Phulchhab' and 'Indian Express' both Rajkot Editions.
6. Matter is adjourned to 26.04.2012 for final hearing.
