Hardik vs Secretary

High Court Of Gujarat|26 March, 2012

JUDGMENT / ORDER

Shri AD Oza, learned advocate for respondent no.1, under instructions state that, let the petitioner approach the Gujarat Secondary And Higher Secondary Education Board, ('Board' for short), through the school for seeking permission on the basis of equivalence, and if the school approaches the Board with all the documents, the Board will consider it on its own merits, without taking into consideration the fact that the school had already given admission. Relaxation is made keeping in mind the future of petitioners/children, but it may not be treated as a precedent hereafter.
In view of this statement, learned advocate for the petitioners seeks permission to withdraw the petition with a view to approach the Board through the school and the school on being approached by the students/petitioners, shall seek appropriate permission from the Board with all necessary documents, and the Board shall decide the same within ten days from the date of receipt of this order.
In view of above, petition is disposed of as withdrawn. Liberty reserved to the petitioners/students to approach the Court afresh in case of future difficulties. Notice discharged. No costs.
