The sole relief claimed in the instant petition is for issuance of a direction to the trial Court to decide Original Suit No. 429/2006, within a time stipulated by this Court.
The petitioner is defendant in the suit. Learned counsel for the petitioner submitted that the plaintiff is repeatedly getting the suit dismissed in default and thereafter, getting it restored, resulting in delay in disposal of the proceedings.
Having regard to the facts of the case and the submissions made, the instant petition is disposed of by directing the trial Court to make all endeavour to decide the suit, expeditiously, without granting unnecessary adjournments.
