Heard learned counsel for the parties.
By means of this contempt application filed under section 12 of the Contempt of Courts Act, 1971 non-compliance of the order of writ Court dated 17.03.2020 passed in Public Interest Litigation No.- 521 of 2020 is complained of.
Sri Mahendra Pratap Singh, learned Standing Counsel submits that he has obtained instruction in the matter in compliance of the order of this Court dated 02.09.2021 and as per the instruction, the order of writ Court dated 17.03.2020 has been complied with by getting encroachment removed from the public utility land giving effect to the order passed under Section 67 of U.P. Revenue Code, 2006 and that too in presence of the applicant.
Copy of the instruction is supplied to learned counsel for the applicant in the Court itself and the same is also placed on record.
In the considered opinion of this Court, there remains nothing for the applicant to continue this contempt application, as the order of writ Court has stood complied with in its letter and spirit.
Contempt application is accordingly consigned to record. Notices issued, if any, stand discharged.
