Heard Sri Raja Ram Kushwaha for the petitioners and Standing Counsel for respondents-1 and 2.
The writ petition has been filed for mandamus directing the respondent-authorities to restrain M/s. R.S.I. Eston Ward Company Pvt. Ltd., Bhopal(respondent-3) from using land of Gata Nos.496/2 and 497/2, situated in village Chandaut Danda, pargana Jalalpur, tehsil Sarile, district Hamirpur for transporting the minerals.
The grievance of the petitioners against respondent-3 is that respondent-3 is transporting minerals through the aforesaid plots of the petitioners due to which the land of the petitioners is ruining. For redressal of their grievance the petitioners have made a representation before the District Magistrate, Hamirpur (respondent-2), which is still pending.
Without entering into the controversy raised by the petitioners, the writ petition is disposed of with the direction to the District Magistrate, Hamirpur (respondent-2) to decide the representation of the petitioners by a reasoned and speaking order after hearing respondent-3, within a period of one month from the date of production of a certified copy of this order before him.
