Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.
By means of this application, the applicant who is involved in case crime no. 65 of 2017, under Sections 498A, 304B and 201 IPC and Section 3/4 Dowry Prohibition Act, Police Station-Amapur, District-Kasganj, is seeking enlargement on bail during the trial.
Learned counsel for the applicant submitted that F.I.R. was lodged by the first informant against the applicant(husband) and nine other co-accused persons for the alleged incident said to have taken place on 27.02.2017. As per the FIR, the marriage of the daughter of the complainant was solemnized with the applicant on 15.02.2015. She was subjected to cruelty by her in-laws for demand of dowry. The applicant is the husband of the deceased. It is also submitted that the applicant is languishing in jail since 25.03.2017.
Learned A.G.A. opposed the bail prayer of the applicant and submitted that almost all the witnesses of facts have been examined in the present case and the trial is at the advanced stage.
Under these circumstances, keeping in view the fact that all the witnesses of facts have been examined and the trial is at the advanced stage, I do not find any good reason to grant indulgence to the applicant.
Thus, the bail application stands rejected.
Learned counsel for the applicant undertakes that he would furnish the certified copy of this order by 10.08.2018.
It is expected from the learned trial court to gear up the trial and made necessary endeavour to conclude the trial latest by 31.12.2018 provided the applicant fully cooperates in conclusion of the trial.
Office is directed to transmit the copy of this order to the learned trial court within 15 days for intimation and necessary compliance.
