M.A. SUBRAMANI, HCGP) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE SHOW CAUSE NOTICE DATED 23.10.2017 VIDE ANNEXURE – E.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Learned Government Advocate to accept notice for respondent Nos.1 and 2 and file memo of appearance in four weeks.
2. The petitioner is before this Court assailing the notice dated 23.10.2017 at Annexure-E to the petition. Through the said notice, respondent No.2 has directed the petitioner to show cause as to why the registration of the petitioner could not be cancelled. Though the learned counsel for the petitioner contends that such action is not justified, inasmuch as the action initiated by the police has already been held as not justified by this Court, those are the aspects which are required to be taken note by respondent No.2 before any further action is taken pursuant to the notice dated 23.10.2017. The petitioner contends that the reply dated 07.11.2017 as at Annexure-G has been filed to the show cause notice.
3. If that be the position, the second respondent shall take note of the reply and thereafter pass appropriate orders in accordance with law.
All contentions in that regard are left open. Petition is accordingly disposed of.
