The petitioner has submitted an application for correction of his name as recorded in the certificate of Intermediate Examination issued by the respondent-Board. The application is pending before the respondent No.3. The only prayer made by Sri Rajan Tripathi, learned counsel for the petitioner, is that the application may be decided, within a stipulated period of time.
Learned Standing Counsel, submits that the respondent-Board is under obligation of law, to decide the application in accordance with law.
No useful purpose will be served by keeping the petition pending.
The matter is remitted to respondent No.3-Additional Secretary, Board of High School & Intermediate Education, Uttar Pradesh, Allahabad Region, Allahabad.
A writ of mandamus is issued, commanding the respondent No.3-Additional Secretary, Board of High School & Intermediate Education, Uttar Pradesh, Allahabad Region, Allahabad, to decide the representation of the petitioner, for correction in his name as recorded in the Certificate of Intermediate Examination, and marks-sheet issued by the respondent-Board, within a period of one month, from the date of, receipt of a certified copy of this order.
It is clarified that this Court has not gone into the veracity of the assertions made in the writ petition, nor has judged the claim of the petitioner on merits. It is for the competent authority to do so with an independent application of mind.
With the aforesaid direction, the writ petition is finally disposed off.
