Heard learned counsel for the parties.
Notice need not be issued to the private respondent no.5 in view of the order proposed to be passed.
Learned counsel for the petitioner states that the fifth respondent, who is the fair price shop dealer, is not distributing the essential commodities to the card holders of the village in question and is selling all the commodities in the open market. In this regard, the petitioner has already filed an application/complaint dated 17.5.2017 before the second respondent for redressal of his grievance, which is still pending. He has confined his prayer only to the relief that his representation dated 17.5.2017 may be considered by the appropriate authority.
Learned counsel for the respondents has no objection to the said prayer.
No useful purpose would be served in keeping the writ petition pending.
In view of above, without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the second respondent to took into the grievance of the petitioner and redress the same strictly in accordance with law within a period of four weeks from the date of production of a certified copy of this order before him.
