Heard Sri Manish Kumar Pathak, learned counsel for the petitioner and learned Standing Counsel for respondent No.1. Notice need not be issued to respondents No.2 to 6 at this stage.
This writ petition has been filed with the following prayer:
"Issue a writ,order or direction in the nature of Mandamus directing the respondent no.1 to decide the restoration application filed by the petitioner under order 9 Rule 13 of C.P.C. in case No. T201801500503008 (Daryab Singh Vs. Mahaveer Singh & others) under section 176 of U.P.
Z.A. & L.R. Act, expeditiously."
It is contended that restoration application filed under Order IX, Rule 13 C.P.C. in Case No. T201801500503008 (Daryab Singh Vs. Mahaveer Singh & others) under Section 176 of U.P. Zamindari Abolition and Land Reforms Act, 1950 is pending consideration before respondent no.1. The sole prayer is for early disposal of the aforesaid restoration application.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no. 1 to decide the restoration application of petitioner pending in the aforesaid case, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of four months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
