The petitioners are six in number. They have challenged the order passed by the State Government dated 20.2.2009 whereby their application under Section 48(1) of the Land Acquisition Act, 1894, has been rejected and their claim for the said land being Abadi land to be extracted from the land in question and has not been found in favour of the State Government. When the writ petition was entertained in the year 2009 no interim order was passed since then writ petition is lying dormant.
From the record, it appears that no effort has been made by the petitioners to get the matter heard. Today, in the revised call, no one has turned up to press this writ petition.
We have perused the material on record and it appears to us that either the writ petition has become infructuous by efflux of time or the petitioners have lost their interest to pursue the matter.
Accordingly, the writ petition is dismissed as infructuous leaving it open to the petitioners to move recall application in case the cause of action still survives or this order causes any prejudice to their interest.
