Heard Sri D.N. Joshi, learned counsel for the petitioner, Sri Sarkeshwar Mishra, learned counsel holding brief of Sri Vivek Verma for the respondents no. 2 and 3 and the learned standing counsel for the respondent no.1.
The petitioner is stated to have retired from service on 01.12.2014 and only a sum of Rs. 3,70,920/- has been paid to him as retiral dues. He is claiming the amount of insurance, ACP benefit, leave encashment, benefit of 7th pay scale and arrears of pension.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with the consent of learned counsel for the parties with a direction to the respondent no.2-Nagar Ayukta, Nagar Nigam Motijheel, District Kanpur Nagar to consider and decide the claim of the petitioner and pass appropriate orders in accordance with law, within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
