HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 30201 of 2014 ORDER:
Case of the petitioner is that she is owner of property bearing Door No.14/194 in Survey No. 313, Proddatur revenue village, Proddatur mandal, YSR Kadapa district. Husband of the petitioner purchased land to an extent of Ac.0.02 cents in the year 2004 and building was constructed thereon. Petitioner traces history of the transactions that took place. When petitioner intends to dispose of the said property and approached the Sub Registrar/3rd respondent, she was informed that entire extent of land covered by Survey No. 313 is classified as ‘Mangala Inam (Barber Inam)’’, therefore no deed of conveyance can be processed.

Learned counsel for petitioner submits that concerning the same survey number several writ petitions were instituted and this Court in W.P.No.15804 of 2013 after considering the objection of Tahsildar, passed orders directing to receive and process the deed of conveyance without reference to entries made in the revenue records on the issue of classification of the land as ‘Mangali Inam’.

Having regard to the earlier judgment of this court in W P No. 15804 of 2013 concerning the same survey number i.e. Survey No. 313, petitioner is at liberty to present the deed of conveyance concerning the property mentioned above and as and when such deed is presented, Sub Registrar- 3rd respondent shall receive and process the same in accordance with Registration Act, 1908, and the Indian Stamp Act, 1899 without raising objection that the said land is classified as ‘Mangali Inam’. However, if the Sub Registrar has any other valid reason for rejecting registration, he shall pass appropriate orders assigning the reasons and communicate the same to the petitioner. Mere registration shall not dis-entitle the State for asserting its title by due process of law.
Writ petition is accordingly disposed of . No costs.
