Heard learned AGA for the State and perused the record.
This anticipatory bail application has been filed by the applicant-Hanuman Yadav in Case Crime No. 153 of 2020 under Section 8/20 and 27A N.D.P.S. Act, Police Station Obra, District Sonebhadra.
Learned A.G.A. has pointed out that offence in which the anticipatory bail has been sought by the applicant, includes the offence under N.D.P.S. Act and according to Section 438 (6) Cr.P.C. anticipatory bail is barred under the provision of N.D.P.S. hence filing of the instant anticipatory bail application is not maintainable.
In view of aforesaid submission, the instant anticipatory bail application is dismissed.
