Heard Sri Chandra Kant Tripathi, learned counsel for applicant, learned A.G.A. for the State and perused the record.
This application u/s 482 Cr.P.C. has been filed by applicant for expeditious disposal of Criminal Case No.3187 of 2009 (State Vs. Shivnath) under Sections 419, 420, 467, 468, 211 IPC, P.S. Kotwali, District Basti pending before learned Chief Judicial Magistrate, Basti.
It is submitted by learned counsel for applicant that on account of lingering tactics adopted by accused/opposite party no.2, the case could not be concluded and it is pending since 2009.
In view of above, without commenting on the merits of the case, learned Chief Judicial Magistrate, Basti is directed to expedite the matter and conclude the trial as early as possible without granting undue adjournment to either of the parties preferably within a period of one year from the date of production of copy of this order, unless there is any legal impediment.
With the aforesaid directions, the application is disposed of.
