Heard Jai Prakash Singh, learned counsel for the petitioners and learned Additional Chief Standing Counsel for the State.
Considering the order proposed to be passed and as the opposite parties would also be interested in expeditious disposal of the proceedings before the Court below, issuance of notice to private opposite parties is dispensed with.
After arguing the matter at some length learned counsel for the petitioners confined his prayer for expeditious disposal of the restoration application which now stands revived on account of the impugned orders setting-aside the order by which the same had been allowed earlier.
Considering the facts of the case as the opposite parties no. 4 and 6 would also be interested in expeditious disposal of the restoration application it is provided that the petitioners herein shall implead the opposite parties no. 4 and 6 herein as parties in the restoration application/ proceedings and thereafter, the proceedings shall be held in accordance with law after notice to the opposite parties no. 4 and 6. The same shall be concluded within a period of six months from the date a certified copy of this order is submitted as aforesaid.
It is open for the petitioner to move an application seeking interim relief before the Court below where the restoration application is pending only to the extent that the property in question should not be alienated. If any application is filed the same shall be considered at the earliest.
With the aforesaid observations/ directions, the writ petition is disposed of.
