1. Heard learned counsel for the parties.
2. Petitioner came to be appointed Work Charge Employee with the fourth respondent, Executive Engineer, Sharda Sahayak Khand, Azamgarh, on 17 February 1982. Thereafter, the services of the petitioner came to be regularized w.e.f. 1 January 1991. Petitioner retired on attaining the age of superannuation on 30 April 2000. By the instant writ petition, petitioner seeks the following relief:
"to issue a writ, order or direction in the nature of mandamus directing the respondents to include the period of service rendered in work charge establishment by the petitioner with his regular service for computation of qualifying service for grant of pension with all other consequential benefits on the basis of judgment of Hon’ble Supreme Court passed in Civil Appeal No. 6798 of 2019 Prem Singh vs. State of Uttar Pradesh and others decided on 2.9.2019.”
3. Learned Standing Counsel submits that the fourth respondent shall consider and decide the claim of the petitioner expeditiously.
4. In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the fourth respondent, Executive Engineer Sharda Sahayak Khand-32 Azamgarh, shall consider and decide the claim/representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within eight weeks from the date of filing of certified copy of this order along with the copy of the writ petition.
5. With the aforementioned observations/directions, the writ petition stands disposed of.
