This writ petition has been preferred challenging the order dated 5th April 2010 passed by the learned Addl. District Judge & Presiding Officer, Fast Track Court, Amreli in Civil Misc. Application No. 82 of 2009 rejecting the request of condoning the delay of 8 years in challenging the judgment and decree dated 30th August 2001.
Learned advocate appearing for the petitioner has urged that the copy of registered Will from the office of Sub-Registrar, Amreli has been obtained which was not available with the petitioner. For the reasons enumerated in the petition, substantive cause may be upheld.
Hence, Notice to the respondent no. 2/1 returnable on 10th May 2012. Direct service is permitted.
