JUDGMENT / ORDER

Petitioners apprehend arrest in Crime No.1193 of 2011 of the Kasargod Police Station for the offences punishable under Sections 143, 147, 148, 342, 324 and 365 read with Sec.149 of the Indian Penal Code and have filed this application. 2. Learned Public Prosecutor submitted that the 1st petitioner is the 5th accused while the 2nd petitioner is not so far identified as accused. It is submitted that on 20.12.2011 at about 6.00 p.m the 1st petitioner and others abducted the de facto complainant in a car and beat him. Rs.1,000/- and the mobile phone belonging to him were taken. The CCTV footage disclosed the incident.
3. Learned counsel submitted that the allegations are not true. It is submitted that for an incident that allegedly occurred in the year 2011, the petitioners are now being proceeded against.
4. As submitted by the learned Public Prosecutor, the CCTV footage gave clue to the incident. Investigation is required. Whether the 2nd petitioner is involved is also a matter to be

6. Having regard to the circumstances of the case, request for pre-arrest bail cannot be allowed. In case the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of as above.
