(ORAL) This writ petition has been filed by the petitioner praying for a direction to the Presiding Officer, Sambhal in charge of execution of order passed in Release Application under section 23 of U.P. Act No. 13 of 1972 to conclude the proceedings started in Execution Case No. 3 of 2015 in April, 2015 as expeditiously as possible.
Learned counsel for the petitioner submits that the execution proceedings started for execution of judgment and order dated 03.02.2015 in Original Case No. 5 of 2007 (Hamid Ullah Khan vs Shambhu Saran and others) has been pending before the Presiding Officer concerned for the past three years.
Learned counsel for the petitioner has filed a copy of the order sheet, which shows that the case has been listed on several dated and was lastly listed on 07.05.2018, yet the proceedings have not been concluded. A request has been made for a direction to be issued as aforesaid.
I have perused the order sheet. It appears that more than 20 dates have been fixed, but the matter could not be concluded.
This writ petition is disposed of with a direction to the Presiding Officer concerned to conclude the proceedings initiated under section 23 of the U.P. Act No. 13 of 1972 within a period of three months from the date a certified copy of this order is produced before him.
