Halimaben vs Sachiv

High Court Of Gujarat|26 April, 2012

JUDGMENT / ORDER

This petition under Articles 226 and 227 of the Constitution of India is an abuse of process of law by the petitioner in seeking further direction against the Deputy Collector, Mamlatdar and other Government Authorities including the private respondents on the basis that one documents was forged in the year 1975 and also seeking direction to the authorities to carry out proper investigation pursuant to the registration of F.I.R. being C.R.No.I-9 of 2012 with Radhanpur Police Station, Patan.
So far as registration of F.I.R. is concerned at this stage, this Court Court is not inclined to make any comment but from the record, it appears that order under Section 79A was passed vesting the land into Government and thereafter, no further proceedings have taken place.
In the above circumstances, no investigation needs to be carried out by the Investigating Agency.
The petition being devoid of any merits, is hereby rejected.
