Heard counsel for the petitioners and learned standing counsel.
By this petition, the petitioners seek a direction in the nature of mandamus commanding the respondent no. 5-Assistant Consolidation Officer, IInd, Jhansi to take decision on the petitioners' application said to have been filed on 24.4.2018 under section 12 of the U.P. Consolidation of Holdings Act, 1953, within a stipulated period of time.
Contention of the learned counsel for petitioner is that the aforesaid application was moved by the petitioners on 24.4.2018 on the basis of registered will deed dated 9.5.2003 executed by the petitioners' father in their favour but no decision has been taken thereon as yet.
The said application has recently been moved and even four months have not passed from the date of the application.
In the facts and circumstances of the case, a direction is issued upon respondent no. 5-Assistant Consolidation Officer, IInd, Jhansi to take decision on the petitioners' application under section 12 of the U.P. Consolidation of Holdings Act, 1953, in accordance with law expeditiously.
With the above direction, the writ petition stands finally disposed of. No order as to costs.
