Sri Manish Kumar Singh holding brief of Sri Deepak Kumar Singh submitted that he is appearing on behalf of the appellant No. 3, Bhanwar Pal. He further submitted that the memo of appearance has already been filed before the Registry.
The office shall trace out the same and place it on record. As per the report of the Chief Judicial Magistrate, Hathras, appellant No. 1, Bhanwar Pal expired 18 years ago and appellant No. 2, Ram Prasad expired on 01.02.2014. The enquiry was conducted as per the circular of this Court.
In view of the report of the Chief Judicial Magistrate, Hathras confirming the death of the appellants Hakim and Ram Prasad, the appeal has lost its efficacy accordingly, the appeal stands abated.
In case the lower court has not been received, the office is directed to send the reminder to the District Judge concerned for requisition of the record within a period of three weeks. After the receipt of the lower court record, the office shall proceed to prepare paper book and the case be listed for final hearing before the appropriate Bench showing the name of Sri Deepak Kumar Singh, as counsel for the appellant No. 3.
