Heard Sri R.P. Singh, learned counsel for the applicant, Sri Ashish Pandey, learned A.G.A. for the State.
The first two bail applications of the applicant were rejected by this Court vide orders dated 24.11.2014 and 2.9.2016, hence this third bail application has been moved on behalf of the applicant.
The new ground which has been argued by the learned counsel for the applicant is that while rejecting the second bail application of the applicant this Court directed the trial court to expedite the trial of the present case within a period of eight months from the said date and the said order was placed by the applicant before the trial court on 28.9.2016 but the same has not been concluded as yet as the court in which the trial of the applicant is pending was lying vacant but recently a Presiding Officer has been appointed there, hence the applicant, who is in jail since 13.4.2014 be released on bail.
Learned A.G.A. vehemently opposed the prayer for bail and submitted that the trial is in progress.
Without expressing any opinion on the merits of the case and considering the submission advanced, I find no good ground for grant of bail to the applicant Hakim Kewat involved in Case Crime No. 205 of 2014 under sections 376-D, 120-B, 504, 506 I.P.C. and 3 (2) (5) S.C./S.T. Act, police station Shahganj, District Sonbhadra.
Accordingly, the bail application is rejected.
However, the trial court is directed to expedite the trial of the aforesaid case and conclude the same on day to day basis within a further period of four months from the date of production of a certified copy of this order.
In case the trial is not concluded within the aforesaid period, the applicant will be at liberty to move fourth bail application.
