Heard learned counsel for the applicant and the learned AGA.
This application u/s 482 Cr.P.C. has been filed seeking direction to the court below to decide the case no. 2826 of 2015, arising out of case crime no.322 of 2014, under Sections 498-A, 452, 504, 506 IPC and 3/4 D.P. Act, P.S. Bhelupur, District - Varanasi expeditiously.
It appears that one application u/s 482 no. 3465 of 2016 is still pending. Applicant is complainant / informant. Trial court has already proceeded with the trial on the basis of law laid down by Apex Court in ASIAN RESURFACING OF ROAD AGENCY PVT. LTD. & ANR.
vs.CENTRAL BURUEAU OF INVESTIVATION. Thus, there is no need to issue fresh direction to the Court below to decide the case in a particular manner. The application being devoid of merits is liable to be dismissed and same is accordingly dismissed.
