On 29th October, 2012 this Court has passed following order:
Despite service of Bailable Warrant upon the applicant herein original accused, the applicant has chosen to remain absent when the matter is taken up for hearing.
Under the circumstances, Registry is directed to issue Non-bailable Warrant against the applicant herein, making it returnable on 8/11/2012. TO be served through the concerned/Nadiad Police Station.
Today when the matter is posted on board, attention of the Court is drawn to the report dated 08th November, 2012 by the learned Additional Civil Judge and JMFC, Kheda at Nadiad, stating inter alia that as per the report of the Nadiad Town Police Station, accused was not found and non-bailable warrant received could not be executed due to short time.
Having regard to the above, time to execute the non-bailable warrant on the accused is extended till 13th December, 2012. By that time, it may be ensured that the non-bailable warrant is served and executed upon the accused.
The matter is adjourned to 13th December, 2012.
