JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) Rule.
Ms.Shah, learned APP waives service of rule on behalf of the respondent-State.
By the present application, the applicant-convict has prayed that she may be enlarged on temporary bail as she wants to attend his ailing son.
From the medical certificate, which is annexed with the application, it is found that applicant' son is suffering from typhoid.
Sickness is not such where the discretion to enlarge the applicant on bail can be exercised.
Under the circumstances, the application is rejected. Rule discharged.
